Annotation

This collection of articles, reports, and regulations discusses various dispute resolution alternatives (ADR), issues unique to the use of ADR by Federal agencies, and experiences of Federal agencies that have initiated ADR programs.

Abstract

Section 1 provides an overview of ADR, both generally and in the Federal Government context. Section 2 focuses on specific ADR mechanisms, particularly mediation, minitrials, and arbitration. Also covered are negotiation, mandatory settlement conferences, summary jury trials, and court-appointed masters. Section 3 describes current Federal policies and practices relating to ADR. Section 4 presents forms and procedures that have been or can be used to implement minitrial, mediation, or arbitration programs. This section includes materials developed by private groups, as well as by several Federal agencies, including the Department of the Army and the U.S. Environmental Protection Agency. Articles in the final section consider issues that arise in implementing ADR, such as acquiring the services of neutrals, the need for confidentiality, and the potential for resistance on the part of participants.
